Distance Sales Agreement

In this regard, it is the determination of the rights and obligations of the parties in accordance with the provisions of the Law No. 4077 on the Protection of Consumers and the Regulation on the Application Procedures and Principles of Distance Contracts (together, the “Legislation”).

3. Delivery 3.1. If you request a delivery different from the one used or applied by HABIT under normal conditions, an additional fee will be invoiced to you depending on the speed and method of delivery. HABIT is not responsible for any additional fees incurred.

3.2 With the delivery, the risk of damage and loss of the material will pass to the buyer unless a report is kept.

4. Payment

4.1 Ordered materials shall be paid in full by credit card before dispatch.


Buyer’s Commitments

The buyer declares on the website that he has read the preliminary information about the basic characteristics, sales price, payment method and delivery of the product subject to the contract and has given the necessary confirmation in the electronic environment. By confirming this contract electronically, the Buyer confirms that he has obtained the correct and complete information about the address to be given to the consumer by the Seller, the basic features of the ordered products, the price of the products including taxes, and the payment and delivery information before the conclusion of the distance contracts. Commitments of the Seller The Seller undertakes to deliver the product subject to the contract in a sound, complete, in accordance with the qualifications specified in the order and with warranty documents and user manuals in cases where delivery is obligatory in accordance with the legislation. If the Seller fails to fulfill its contractual obligations in the event that the delivery of the product subject to the contract becomes impossible, it shall notify the Buyer of this situation and may, at the Seller’s discretion, supply a different product of equal quality and price or return the product price. In the payments made by the Buyer by card, the Seller returns the product price to the relevant bank within ten days after the order is canceled by the Buyer. After the Seller returns the canceled order amount to the relevant bank, the Seller is not responsible for the prolongation of the time for the bank to return the said amount.

Delivery time

It will be delivered within 7 working days on average, depending on the product. The delivery of the products that cannot be delivered within the specified time can be extended up to a maximum of 30 days from the day the order is delivered in accordance with the Legislation; furthermore, this period may be extended for another ten days, provided that the Buyer is notified beforehand in writing or by a permanent data carrier.

Delivery Method

The delivery of the product shall not be made to anyone other than the person or persons authorized to take delivery specified in this contract and determined by the Buyer. During the delivery, it is obligatory to present the identity of the persons authorized to receive the delivery. If these people do not present their identity cards, they will be refrained from making deliveries. If the product subject to the contract is to be delivered to a person or persons other than the Buyer, the Seller cannot be held responsible if the person or persons to be delivered do not accept the delivery.

Packet Stop and restart conditions

The buyer can stop and restart the purchased package as many days as he wishes within 3 months from the date of purchase. If he/she wants to start the package again within 3 to 9 months from the date of purchase, the total amount of days not used from the package is divided by the current price of the package and the number of days is calculated.

Packages that are not used within 9 months from the date of purchase will be canceled, the seller does not have to make any payments to the buyer.

Right of Withdrawal

The buyer has the right to withdraw from the contract within seven days from the date of receipt of the product, without giving any reason, by rejecting the product from the contract and without assuming any legal and penal responsibility. The period of the right of withdrawal starts to run from the day the Buyer receives the product. However, the Buyer cannot use the right of withdrawal for products that are food products. The Buyer shall notify that the right of withdrawal has been exercised, in writing, to the e-mail address [email protected] or via the permanent data carrier. Notices of the right of withdrawal sent to the [email protected] e-mail address must include the order number subject to withdrawal, the product and quantity subject to withdrawal, and telephone number. Upon notification of the Buyer’s use of the right of withdrawal, the Seller undertakes to return the total amount received within ten days from the date of receipt of the notification and any documents that put the Buyer under debt without incurring any expense to the consumer. The seller will take back the product within twenty days from the receipt of the right of withdrawal notice. With the exercise of the right of withdrawal, the products to be returned must be delivered with the box, packaging, standard accessories, if any, and the products given as a gift with the product. While the product subject to the right of withdrawal is returned to the Seller, the original invoice submitted to the Buyer during the delivery of the product must also be returned. The return section of the invoice to be returned with the product will be filled in and signed by the Buyer. There are products that cannot be subject to the right of withdrawal due to their nature. Products that cannot be returned due to their nature, rapidly deteriorating and expired products, disposable products, hygienic products including food products, all kinds of software and programs that can be copied. In addition, in order for the right of withdrawal to be exercised, the packaging of the products must be unopened, intact and unused.

The seller can cancel the package as he wishes by deducting the amount of the days used by the buyer and returning it.

In Habit nutrition packages, separate special prices are applied for 1-week, 4-week, 8-week and 12-week, 5, 10-day, 15-day, 20-day, 21-day, 28-day, 30-day, 45-day, 60-day, 66-day packages. Resolution of Disputes In disputes that may arise from this contract, Consumer Arbitration Committees up to the value declared by the Ministry of Industry and Trade, Consumer Courts over the specified value; Istanbul Courts of First Instance are authorized in places that cannot be found.
